1. Acceptance of Terms

By accessing and using MusicFlowAI ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

MusicFlowAI is an AI-powered music generation platform that provides:

AI-generated lyrics and music production
Audio generation and processing
Video creation and editing tools
YouTube publishing capabilities
Content management and organization

3. User Accounts

To access certain features of the Service, you must register for an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and update your information to keep it accurate and current
Maintain the security of your account credentials
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

4. Content Ownership and Rights

4.1 Your Content

You retain any rights you hold in the content you create using the Service, including lyrics, music, and videos, subject to the licenses below. By using the Service, you grant us a limited license to:

Store, process, and transmit your content to provide the Service
Make backup copies for disaster recovery and business continuity
Use aggregate anonymized data for service improvement and analytics

4.2 AI-Generated Content

Content generated using AI tools is provided "as is." You are responsible for reviewing and ensuring that AI-generated content complies with applicable laws, including copyright and intellectual property rights. We do not claim ownership of AI-generated content created through your use of the Service.

4.3 Free Songs After 30 Days

If your account has not converted to a paid subscription within 30 days after account creation, you grant MusicFlowAI and its owners and operators a non-exclusive, worldwide, royalty-free license to use eligible songs generated under your free plan. For this policy, one month means 30 consecutive days. A paid subscription includes a subscription purchased through our website or an app store; a free trial alone does not count as a paid subscription.

For new accounts, eligible songs are songs generated under the free plan after you accept this section and before your first paid subscription. The license begins at the later of the end of your account's first 30 days or the eligible song's creation. It includes the generated audio, lyrics, title, and accompanying generated cover artwork, only to the extent you have rights to license them. Existing accounts and previously generated songs are addressed below.

Permitted uses include, without limitation, copying, editing, adapting, synchronizing with video, displaying, performing, publishing, distributing, promoting, and monetizing eligible songs in any media. Examples include marketing and advertising, product demonstrations, websites, social media, YouTube uploads and monetized channels, streaming services, playlists, compilations, and other promotional or commercial releases. We may authorize our service providers, distribution platforms, and promotional partners to exercise these rights on our behalf. No additional payment, royalty, attribution, or per-use approval is required, except where applicable law requires otherwise.

You keep your rights and may continue using your songs. This license does not transfer ownership or allow us to claim exclusive rights against you. Upgrading within the first 30 days prevents this license from taking effect. Once it takes effect for an eligible song, it continues for the duration of the rights you can license, including after a later upgrade or account deletion, subject to applicable law. Songs generated after your first paid subscription are excluded, even if you later return to the free plan.

This section does not authorize disclosure of private account details, unpublished prompts, uploaded source files, or personal information embedded in a song. It does not grant rights to a person's name, likeness, or voice, or to third-party material that you cannot license. It does not grant permission to train AI models on your content.

For existing free accounts, we will provide an in-app notice or email describing this change and a shared review period of 30 consecutive days from publication of this policy version. The same publication deadline applies to all accounts that existed before publication, even if you first view the in-app notice later. The proposed license includes songs previously generated under the free plan. If you request account deletion or object to reuse during that period, we will not rely on this notice to use your songs. A timely request counts even if account deletion has not yet been completed. Upgrading to a paid subscription during the review period also excludes your songs from this notice-based transition. Where applicable law permits this change through notice and an opportunity to object, the license takes effect after the review period if you remain free and have not requested deletion or objected. Where affirmative consent or another authorization is required, we will obtain it before using previously generated songs; silence, inactivity, and failure to delete an account do not replace legally required consent. We will retain records of notice delivery, objections, and any required authorization.

5. Acceptable Use

You agree not to:

Use the Service for any illegal or unauthorized purpose
Generate content that infringes on third-party intellectual property rights
Create content that is defamatory, obscene, threatening, or harassing
Attempt to gain unauthorized access to the Service or related systems
Use automated means to access the Service except through our official API
Reverse engineer, decompile, or disassemble any part of the Service
Resell, redistribute, or sublicense access to the Service without permission
Overload or interfere with the proper functioning of the Service

6. Third-Party Services

The Service integrates with third-party platforms including:

YouTube (for video publishing)
Various AI service providers (for content generation)
Cloud storage providers

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

7. Payment and Subscriptions

Some features of the Service may require payment. By subscribing to paid features:

You agree to pay all applicable fees as described at the time of purchase
Fees are non-refundable except as required by law
Subscriptions auto-renew unless canceled before the renewal date
We reserve the right to change pricing with advance notice
You are responsible for all taxes associated with your purchase

8. Service Availability

We strive to provide reliable service but cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify or discontinue features with reasonable notice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS
WE ARE NOT RESPONSIBLE FOR CONTENT GENERATED BY AI TOOLS
YOU USE THE SERVICE AT YOUR OWN RISK

10. Indemnification

You agree to indemnify and hold harmless MusicFlowAI and its affiliates from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

11. Copyright and DMCA

We respect intellectual property rights. If you believe content on the Service infringes your copyright, please contact us with:

A description of the copyrighted work
Location of the infringing material
Your contact information
A statement of good faith belief
A statement under penalty of perjury
Your physical or electronic signature

12. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may terminate your account at any time through your account settings. Upon termination:

Your right to access the Service immediately ceases
We may delete your account data in accordance with our Privacy Policy
You remain liable for any outstanding payments
Provisions that should survive termination will remain in effect

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the updated Terms. Section 4.3 governs the notice period and any additional consent required for existing accounts and previously generated songs.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where MusicFlowAI operates, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, except where prohibited by law.

16. Apple App Store and iOS Subscriptions

If you use MusicFlowAI through the iOS app, the following terms apply in addition to the rest of these Terms:

16.1 In-App Purchases

All in-app purchases are processed by Apple via the App Store using your Apple ID. Apple is the merchant of record.
Mobile Weekly — $4.99 / week. Includes 30 song generations per week and local video exports.
Mobile Annual — $69.99 / year for new subscriptions. Includes up to 500 song generations, 100 image generations, and 100 caption generations per year. Existing $49.99 annual subscriptions retain their original price and allowances while they remain on that subscription.
Prices may vary by region. The price shown in the App Store at the time of purchase is the price you pay.

16.2 Auto-Renewing Subscriptions

Subscriptions automatically renew at the end of each billing period (weekly, monthly, or annual, as applicable) unless auto-renewal is turned off at least 24 hours before the end of the current period.
Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the displayed renewal price.
You can manage subscriptions and turn off auto-renewal at any time in your Apple ID Account Settings (on iOS: Settings → [your name] → Subscriptions).

16.3 Cancellation and Refunds

You may cancel a subscription at any time before the next renewal via your Apple ID Account Settings. Cancellation takes effect at the end of the current paid period; you keep access until then.
Refunds, if any, are handled by Apple under their refund policy at https://support.apple.com/billing. We do not issue refunds for App Store purchases.

16.4 Restore Purchases

If you reinstall the app or sign in on a new device, you can recover an active subscription by tapping Restore Purchases in the Settings tab.

16.5 Free Guest Mode

The iOS app lets you generate up to three free songs without creating an account. Guest songs are stored on your device only and may not sync across devices. To keep your library and unlock paid features, create or sign in to an account.

16.6 Apple Standard EULA

Where Apple's Standard End User License Agreement applies (available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/), you accept it by using the iOS app, in addition to these Terms. If there is any conflict, the Apple Standard EULA controls only to the extent required by Apple's App Store guidelines.

17. Account Deletion

You can delete your account at any time:

iOS: Settings tab → Delete Account. This signs you out and removes your MusicFlowAI account from our servers.
Web: Account dashboard, or by emailing support@musicflowai.com.

When your account is deleted, your authentication record is removed immediately. Generated content and related data tied to your account will be deleted or anonymized within 30 days, except where retention is required by law. Deleting your MusicFlowAI account does not automatically cancel an active App Store subscription — you must also cancel the subscription in your Apple ID Account Settings to stop future charges.
